Vehicle Rental Terms and Conditions

This rental agreement is between Christo Enterprises Ltd T/A Ikonic Kampers, a company registered in England and Wales under company number 05732380 and with its registered office at Yorkshire Accountancy Ltd, First Floor Offices, County House, Dunswell Road, Cottingham, East Yorkshire, HU16 4JT, (“Ikonic”) and you (the “Hirer”).

By hiring the vehicle, you are accepting these terms and conditions (the “Terms”).

If you have any questions regarding these Terms, please call us prior to collecting the vehicle.

Booking and payment

Prospective hirers may book and/or get a quotation through Ikonic’s website or by calling Ikonic on 01759 318343.

To reserve the vehicle, the Hirer must pay a non-refundable deposit of £250. Upon receipt of this deposit, Ikonic will send the Hirer a booking conformation.

Ikonic must receive the balance of the hire charge no later than 42 days prior to start of the hire period. If such payment is not received and Ikonic receives no response from the Hirer by email or telephone, then Ikonic may cancel the booking.

For bookings made within 42 days of the start of the hire period, full advance payment is required and must be received by Ikonic within one working day of the booking being made. the minimum hire period is 3 days

The minimum rental period is 3 days.

The rental fee includes comprehensive insurance for up to 2 named drivers, breakdown cover and unlimited mileage within the European countries named below.

Insurance

There is a £500 insurance excess which the Hirer hereby undertakes to pay to Ikonic on Ikonic’s demand following any incident where an insurance claim is made. Ikonic will ordinarily deduct this excess from the security/damage deposit.

The vehicle’s insurance does not include cover for personal belongings. As such, Ikonic recommends that the Hirer arranges suitable insurance cover for the duration of the hire period.

The vehicle’s insurance and breakdown cover is only valid in the following countries:

Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Republic of Ireland, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland and the United Kingdom.

Travel outside of these countries will represent a breach of these Terms and will invalidate the vehicle’s insurance and breakdown cover. The Hirer will be fully liable for all costs and damages, howsoever incurred, if the Hirer takes the vehicle outside of the listed jurisdictions.

Security deposit

Before Ikonic permits the Hirer to hire the vehicle, the Hirer must pay a security/damage deposit of £750 by a credit card in the name of the Hirer (or, if more than one Hirer, in the name of the person who will be the main driver of the vehicle during the hire period).

Ikonic will return this deposit in full within 7 days of the vehicle’s return if the Hirer returns the vehicle in the same condition as when it was hired out to the Hirer, including all appliances in working order and a full tank of fuel. Ikonic may retain some or all of the deposit to fund any loss, soiling or damage to the vehicle (inside or out), including that resulting from the Hirer’s negligence.

If the security/damage deposit is not sufficient to cover the costs of cleaning and/or repairing the vehicle, the Hirer undertakes and warrants to pay the additional sum to Ikonic on Ikonic’s demand. If the Hirer does not make such payment within 2 working days of Ikonic’s demand for payment, daily interest will accrue on the outstanding sum at the rate of 4% per annum above the Bank of England base interest rate from time to time until Ikonic receives the Hirer’s full payment.

Drivers

Ikonic requires that all named drivers must obtain a DVLA check code prior to the start of the hire period:

Bring the code(s) and/or the PDF(s) with you when collecting the vehicle.

Driver restrictions

Each named driver must be between the ages of 25 and 75 years throughout the hire period and must have held a full driving licence for at least 2 years before the hire period begins.

We require 2 forms of address verification before we release the vehicle to the Hirer. These can be a utility bill or bank statement as long as they show the address of the Hirer (or main driver) and are dated no more than 60 days before the hire period begins. The address on these documents must match the address on the Hirer’s driving licence. (Please note: mobile phone and water bills are not an acceptable proof of address.)

In addition, we will also require to see your plastic driving licence before we release the vehicle to you.

The vehicle may not be driven by any person:

aged under 25 or over 75 years unless otherwise agreed in advance and in writing by Ikonic;

who has not held a full, valid UK or EU driving licence for at least 2 years before the hire period begins;

who has been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and/or has had their driving licence endorsed or suspended or more than 6 penalty points imposed. (“Spent” convictions covered by the Rehabilitation of Offenders Act 1974 may be disregarded);

who has had their insurance declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience and/or has had their insurance or cover cancelled by any motor insurer;

engaged wholly or partly in professional entertainment or professional sports;

who is a jockey, or a person connected with racing or the gaming or betting industry;

who, while driving, has been involved in more than 1 accident in the 3 years before the hire period begins;

who has not held a full UK or EU driving licence for at least 2 years before the hire period begins.

The Hirer’s warranties to Ikonic

The Hirer understands, agrees and warrants to Ikonic that the Hirer:

will (i) collect the third party’s information and witness information at the scene of any accident involving the vehicle during the hire period, (ii) fully and accurately complete the accident report form located in the vehicle’s glove compartment, and (iii) report the accident to the nearest police station and obtain an incident report reference number;

will not admit or accept liability to any party in the event of any accident involving the vehicle during the hire period;

will assist Ikonic in settling any claims arising from an accident involving the vehicle during the hire period (including, but not limited to, attending court if so required);

will lock the vehicle and activate any installed security system(s) when leaving the vehicle unattended, irrespective of the length of time for which it will be left;

will keep the vehicle’s keys safe at all times during the hire period;

will use only the correct fuel and will be liable for the full costs to repair, rectify or replace the vehicle’s engine if they do not;

will be fully liable for damage above cab height caused by low trees, bridges, etc;

will be fully liable for the cost of recovery if the vehicle becomes stuck or bogged down;

will not let anyone except the named drivers operate the vehicle or carry out work on the vehicle without Ikonic’s prior consent;

will immediately report to Ikonic any faults that develop, or damage caused to the vehicle during the hire period;

will not use the vehicle other than on normal public roads;

will not use the vehicle for any purpose other than the normal purpose for which the vehicle is intended;

will not use the vehicle to tow any other vehicle or trailer, or to carry passengers for hire or reward;

will be fully liable during the hire period for the roadworthiness of the vehicle and the safety of its passengers;

will monitor the vehicle’s oil levels, engine coolant, tyre pressures and windscreen washer fluid level regularly throughout the hire period;

will be fully liable for all tolls (including the London congestion charge) incurred during the hire period and all parking tickets, speeding fines and other road traffic violations committed during the hire period;

will not use the vehicle for any illegal purposes (including exceeding speed limits and other breaches of the Highway Code);

will not use the vehicle while under the influence of alcohol or drugs;

will not use the vehicle for the purposes of instructing learner drivers;

will not allow any person other than a named driver to drive the vehicle;

will not use the vehicle wholly or partly for the purpose of any business;

will not sub-rent the vehicle;

will not permit any pets or animals to enter the vehicle during the hire period;

will not fit a roof rack, roof box, bike rack or any other form of external carrier to the vehicle;

will not attempt to make any repairs to the vehicle; and

will immediately report the theft of the vehicle to the nearest police station (obtaining an incident reference number) and to Ikonic.

If the Hirer will be travelling into London with the vehicle during the hire period, please check with Ikonic beforehand to check whether the vehicle is LEZ-compliant. If the Hirer does not do so, the Hirer will be fully liable for any LEZ-related charges incurred during the hire period.

Ownership

The vehicle belongs to Ikonic. The Hirer must not attempt to sell or hire the vehicle before, during or after it is in the Hirer’s possession.

Collection and return

On the collection date, the Hirer may collect the vehicle after 2pm and before 5pm.

On the return date, the Hirer must return the vehicle no later than 10.30am.

Please note: the insurance policy only covers the Hirer until 10.30am on the return date. If the Hirer does not return the vehicle before that time, the Hirer will be liable for a charge of £50 per hour or part-hour after 10.30am, if the vehicle is booked to be hired out again later that day.

Please allow up to 1 hour for a full vehicle demonstration on collection, and 30 minutes for an inspection on return.

Damages, repairs and cleanliness

If, during the hire period, the vehicle sustains any damage, the Hirer must inform Ikonic immediately. If the Hirer does not do so, the Hirer will be fully liable to Ikonic if the repairs needed to the vehicle disrupt or delay subsequent bookings.

Upon receipt of a damage report from the Hirer during the hire period, Ikonic will establish whether the problem can be resolved during the hire period and advise the Hirer what to do. This may mean a visit to a vehicle dealership or repair centre. Ikonic will reimburse the reasonable, pre-agreed costs incurred by the Hirer, supported by a valid VAT receipt. If the costs are not agreed before the Hirer incurs them, Ikonic will not be responsible for their reimbursement.

The Hirer must return the vehicle in a clean and tidy condition with an empty waste water tank, clean toilet and clean and empty toilet cassette. The Hirer will be liable for a charge of £75 for a soiled or unemptied toilet cassette, and a charge of £50 for an unreasonably dirty vehicle interior. Smoking is not allowed in the vehicle and the Hirer will be liable for a cleaning charge of £100 if this condition is not complied with. The Hirer will be fully liable for additional charges for repairs/replacements needed to, or stain removal from, the vehicle’s upholstery and carpets.

Fuel and gas

At the start of the hire period, Ikonic will supply the vehicle with a full tank of fuel and the Hirer must return the vehicle with a full tank of fuel. If the vehicle’s fuel tank is not full on return, Ikonic will refuel the vehicle and the Hirer will be fully liable for the cost of the fuel plus a £50 fee to cover the costs incurred by Ikonic in taking the vehicle to be refueled.

At the start of the hire period, Ikonic will supply the vehicle with two full gas cylinders. If more gas is required during the hire period, this is the responsibility of the Hirer. The Hirer must return both gas cylinders with the vehicle at the end of the hire period.

Vehicle availability

Sometimes due to unforeseen circumstances (such as breakdowns or because of damage) a vehicle may not be available at the start of a scheduled hire period. If this happens, Ikonic will try to supply a similar alternative vehicle for the hire period. If this is not possible, Ikonic will issue a full refund to the Hirer.

Ikonic recommends that the Hirer takes out a suitable policy of holiday cancellation insurance to protect against any such events.

Cancellation by the Hirer

If Ikonic receives the Hirer’s written cancellation more than 6 weeks before the start of the hire period, Ikonic will issue the Hirer with a full refund less the non-refundable deposit.

If Ikonic receives the Hirer’s written cancellation within 6 weeks before the start of the hire period, Ikonic will not refund any sums paid to it by the Hirer. However, if Ikonic is able to re-hire the vehicle for the cancelled period, Ikonic will issue the Hirer with a full refund less the non-refundable deposit.

All cancellations must be made in writing and will not be valid until Ikonic receives the written notice, but the Hirer should nevertheless telephone Ikonic first to advise Ikonic of the cancellation.

Recall or termination by Ikonic

Ikonic reserves the right to recall the vehicle immediately at any time. If Ikonic exercises this right, Ikonic will either (i) reimburse the Hirer for all full days remaining in the hire period, or (ii) issue a replacement vehicle of the same or similar standard at no additional cost.

If the replacement vehicle is of a lower standard, Ikonic will refund to the Hirer an appropriate proportion of the hire charge.

Ikonic shall be entitled to terminate these Terms immediately if the Hirer:

is in breach of any of these Terms;

has had their personal belongings confiscated in order to satisfy debts; or

has a receiving order made against them.

If Ikonic terminates these Terms for any of the above reasons:

all payments required under these Terms shall become due and immediately payable; and

Ikonic shall have the immediate right to request the immediate return of the vehicle or repossess the vehicle and may charge the Hirer for all reasonable costs involved in such repossession.

IKONIC’S LIABILITY TO THE HIRER

IKONIC SHALL BE RESPONSIBLE FOR ANY FORESEEABLE LOSS OR DAMAGE THE HIRER MAY SUFFER ONLY AS A RESULT OF IKONIC’S BREACH OF THESE TERMS OR AS A RESULT OF IKONIC’S NEGLIGENCE. LOSS OR DAMAGE IS FORESEEABLE ONLY IF IT IS AN OBVIOUS CONSEQUENCE OF IKONIC’S BREACH OR NEGLIGENCE OR IF IT IS CONTEMPLATED BY THE HIRER AND IKONIC WHEN THE RENTAL AGREEMENT IS FORMED. IKONIC WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE THAT IS NOT FORESEEABLE.

IN ANY EVENT, IKONIC’S TOTAL LIABILITY UNDER THESE TERMS SHALL BE LIMITED TO THE VALUE OF THE CONTRACT BETWEEN IKONIC AND THE HIRER (I.E. THE TOTAL RENTAL FEES PAYABLE BY THE HIRER.

NOTHING IN THESE TERMS SEEKS TO EXCLUDE OR LIMIT IKONIC’S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE (INCLUDING THAT OF ITS EMPLOYEES, AGENTS OR SUB-CONTRACTORS), OR FOR FRAUD OR FRAUDULENT MISREPRESENTATION.

NOTHING IN THESE TERMS SEEKS TO EXCLUDE OR LIMIT IKONIC’S LIABILITY WITH RESPECT TO THE HIRER’S RIGHTS AS A CONSUMER.

The Hirer’s rights as a consumer

Ikonic is required by law to provide the Hirer with goods that are of satisfactory quality, fit for purpose and in accordance with descriptions, samples, models and other pre-contract information provided by Ikonic. If the Hirer discovers any pre-existing damage or fault with the vehicle during the hire period, the Hirer must inform Ikonic immediately.

Ikonic will use all reasonable endeavours to provide a replacement vehicle, or, if a repair is possible without causing the Hirer inconvenience, Ikonic will repair the vehicle (or have it repaired). If Ikonic is unable to replace or repair the vehicle (or have it repaired), or if the Hirer would prefer to reject the damaged or faulty vehicle, whether before or after a repair or replacement (if the replaced or repaired vehicle is still damaged or faulty), Ikonic will offer the Hirer a refund equal to the remaining full days in the hire period.

Ikonic will issue any such refund to the Hirer within 14 days of the date on which Ikonic agrees that the Hirer is entitled to a refund. Ikonic will make any such refund using the same payment method originally used by the Hirer.

Nothing in these Terms shall act to exclude or limit the Hirer’s legal rights as a consumer.

Data protection

All personal information Ikonic may collect (including, but not limited to, the Hirer’s name and address) will be collected, used and held in accordance with the provisions of applicable data protection legislation.

Ikonic may use the Hirer’s personal information to:

provide its products and services to the Hirer;

process the Hirer’s payments; and

inform the Hirer of new products, services or promotions. (The Hirer may request that Ikonic stops sending such information at any time.)

Ikonic has the right to pass on any personal information provided by the Hirer to relevant authorities including, but not limited to, the DVLA and the police.

If the Hirer is in breach of these Terms, Ikonic may also pass on any such information to credit reference agencies and/or debt recovery agencies.

Ikonic will not pass on the Hirer’s personal information to any other third parties without first obtaining the Hirer’s permission.

Events outside Ikonic’s control

Ikonic shall not be liable for any failure or delay in performing its obligations where that failure or delay results from any cause that is beyond its reasonable control. Such causes include (but are not limited to): power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic, or other natural disaster.

Other important terms

Ikonic may transfer, assign or novate its obligations and rights under these Terms to a third party. If this occurs the Hirer will be informed. The Hirer’s rights under these Terms will not be affected and Ikonic’s obligations under these Terms will be transferred to the third party who will remain bound by them.

The Hirer may not transfer (assign) their obligations and rights under these Terms without Ikonic’s prior written consent.

These Terms are between the Hirer and Ikonic. These Terms are not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms.

If any of the provisions of these Terms are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that/those provision(s) shall be deemed severed from the remainder of these Terms, which shall remain valid and enforceable.

No failure or delay by Ikonic in exercising any of its rights under these Terms means that it has waived that right, and no waiver by Ikonic of a breach of any provision of these Terms means that it will waive any subsequent breach of the same or any other provision.

Governing law and jurisdiction

These Terms, the rental agreement, and the relationship between the Hirer and Ikonic (whether contractual or otherwise) shall be governed by, and construed in accordance with, English law.

Any dispute, controversy, proceedings or claim between the Hirer and Ikonic relating to these Terms, the rental agreement, or the relationship between the Hirer and Ikonic (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England, Wales, Scotland or Northern Ireland, as determined by the Hirer’s residency.
